Constitutional Amendment to Overturn Citizens United

Senate Democrats Introduced a Constitutional Amendment to Undo the 2010 Citizens United Supreme Court Decision.

A Group of Democrats, led by Sen. Tom Udall (D-NM), and Progressive Activists rallied outside the Supreme Court to Unveil the Amendment, which faces an Unlikely Path to being Ratified.

"Few decisions in the 200 and some odd years of this republic have threatened our democracy like Citizens United. People say they want to get rid of the swamp. Citizens United is the embodiment of the swamp," Senate Minority Leader Charles Schumer (D-NY) said at the Rally.

Schumer added that "overturning Citizens United is probably more important than any other single thing we could do to preserve this great and grand democracy."

Democrats Pledged that if they took Control of the Senate during the 2020 Election, they would bring Legislation Overturning Citizens United up for a Vote.

"We reported this amendment to the floor [in 2014]. What happened to it? A [Senate Majority Leader Mitch] McConnell [R-KY] filibuster happened to it. ... With a new leader by the name of Schumer in the Senate, we can be sure that it won't be a filibuster stopping us," said Sen. Dick Durbin (D-IL), the No. 2 Senate Democrat.

The 2010 Supreme Court Ruling Prohibited the Government from Limiting Spending by Companies, Nonprofit Organizations, and Unions, on Political Campaign Advertisements. The Court's Majority wrote that such Provisions would Inhibit Freedom of Speech.

The Senate Democratic Amendment would let Congress and States set Rules on Spending and Money in Elections.

But to be added as an Amendment to the Constitution, the Democratic Proposal would Need to be Approved by Two-Thirds of both the House and Senate and be Approved by Three-Fourths of the States.

Rep. Adam Schiff (D-CA) introduced his Own Amendment to nix Citizens United in May 2019.

"The Supreme Court's decision in Citizens United overturned decades of legal precedent and has enabled billions in dark money to pour into our elections," Schiff said in a Statement.

The Supreme Court Decision also resulted in many Public Company Stockholders to try to Limit Corporate Political Spending at Annual Meetings.

Constitutional Amendment to overturn Citizens United

New Hampshire became the 20th State to Support a Constitutional Amendment to Overturn the 2010 Citizens United Decision and Restore our Democracy.

Today’s Victory in New Hampshire is the Product of years of Organizing in the Granite State.

New Hampshire have passed 82 Local Resolutions in support of an Amendment, which would establish that Corporations Don’t have a Right to participate in Elections and that Campaign Money does Not Equal Speech.

Thousands of Residents attended Hearings, called State Lawmakers, Signed Petitions, and turned out for Demonstrations.

We need Co-Sponsor H.J.Res. 2, the Democracy for All Amendment.

The Democracy For All Amendment (H.J.Res. 2) has been introduced by Rep. Ted Deutch (D-FL, 22nd District), and already has 101 Cosponsors. This proposed Amendment would allow Congress and the States to Regulate and Set Limits on the Raising and Spending of Money in our Elections, as well as Legally distinguish between the Rights of People and Corporations.

Constitutional Amendment to Overturn Citizens United

The financial effect of disastrous U.S. Supreme Court rulings like Citizens United resulted in a midterm that cost almost $4 billion.

In the months ahead, New Yorkers will renew the campaign to make the Empire State the next to call for a constitutional amendment to overturn Citizens United.

The campaign launches with showings throughout New York of the powerful documentary “Pay2Play”.  This will build momentum for a rally in Albany in January on the fifth anniversary of Citizens United.

CLICK HERE for more information about the documentary and where it is playing.

Last year, New York was just three state legislators short of becoming the 17th state to formally call for an amendment.

All across New York, voters are outraged that a few billionaires continue to try to buy our democracy.

In the 2014 midterm election, outside special interests did more than ever before to corrupt our elections.

The fifth anniversary of the U.S. Supreme Court ruling that enabled that corruption is right around the corner – and New Yorkers are gearing up to fight to make this the last anniversary before Citizens United is overturned.
