A Federal Judge Upheld New York’s "Green Light Driver’s License Law for Undocumented Immigrants" Rejecting the Trump (R) Administration’s Claim that the State Measure Conflicts with Federal Immigration Law. New York Gov. Kathy Hochul (D) and Attorney General Letitia James (D) were Named in the Lawsuit.
The New York Green Light Driver’s-License Law, officially known as the Driver's License Access and Privacy Act, allows New Yorkers aged 16 and Older to Apply for a Standard Driver's License without Needing Proof of Lawful Status. Key points include:
- Applicants do Not need a Social Security Card to Apply.
- The Law does Not Apply to Non-Driver NY State Real-ID Card.
- It provides Privacy Protections against Data Sharing with Immigration Enforcement Agencies.
- The Law was Enacted to Improve Road Safety, and make it Easier for Undocumented Immigrants to obtain Auto Insurance.
The Justice Department (DOJ) said the Law Hindered Federal Immigration Enforcement. The Judge noted Federal Authorities can still Access State Records with a Warrant.
U.S. District Judge Anne M. Nardacci found the DOJ did Not show the Statute Violates the Constitution’s Supremacy Clause.
James said, “As I said from the start, our laws protect the rights of all New Yorkers and keep our communities safe. I will always stand up for New Yorkers and the rule of law.”
Opponents, including Border Enforcement Officials, say the Law can Limit Real‑Time Information Sharing that Protects Officers.
Hector Garza, Vice President of the National Border Patrol Council (NBPC), stated, “Any information that can help law enforcement stay safe as they conduct their duties has pretty much been taken away with this Green Light Law. What the Green Light Law) does: "It Prevents Law Enforcement Agents from Getting any Type of Information in Regards to any Registrations that the State Has.”
“For example, before we engage in traffic stops, typically law enforcement will always conduct a vehicle registration check to see if there are any warrants to see if that person is considered armed and dangerous,” He added.
