NYS Court of Appeals Dismisses Mail-in-Voting Lawsuit


With just a few days to go before Election Day, November 5th, New York's Highest Court has Dismissed a Lawsuit against Mail-in-Voting.

The Challenge was to a New Law that allows All Registered Voters to cast their Ballots by Mail, not just Absentee Voters, called No-Excuse Mail-in-Voting.

The Decision comes about Two weeks after both Parties delivered their Arguments.

Challengers to the Law said the Rule was Unconstitutional, but the New York State Court of Appeals decided Unanimously that the Mail-in-Voting Law does Not Violate any Constitutional Principles. The Court called the Plaintiff's Case "inconsistent."

Early Voting in New York began on Saturday, Oct. 26th. All Residents who choose to Vote-by-Mail, must have their Ballot Postmarked by Nov. 5th.

But the Court Ruled Ballots without a Postmark can be Counted if received by November 8th.
