Special Counsel Jack Smith, notified U.S. District Court Judge Aileen Cannon, that Trump and His Co-Defendants, Walt Nauta and Carlos De Oliveira, "have yet" to produce any Discovery Materials.
In a Three-Page Filing on Tuesday, Smith noted that the Special Counsel's Office, had fulfilled its Obligations to turn over Information about the Classified Documents Case.
"In accordance with the Court's Order of November 10, 2023 (ECF No. 215), the United States of America files this discovery report," Smith wrote.
"That Order contemplates a Joint Discovery Report being filed, but as the Defendants have yet to produce any discovery, the Government has prepared this Report."
Smith said the Prosecution made "eight productions of unclassified discovery," while Trump made None.
Counsel for Trump and His Co-Defendants did Not dispute the Claim.
Trump was Indicted in 2023, on 37 counts of Mishandling Classified Documents.
If Defendant's Fails to produce Discovery, the Court may Impose Sanctions. These Sanctions may include an Instruction for a Negative Inference at Trial, or even the Dismissal of a Claims or Counterclaims, by the Defendents, if the Lawsuit gets past its Initial Stages
