NC BOE Recognizes Green Party is Now Ballot-Qualified

On March 27th, the North Carolina State Board of Elections (BOE) unanimously voted that the Green Party is a Ballot-Qualified Party.

This is because a 2017 Law said that any Party whose Presidential Nominee was on the Ballot in at least 35 States in the previous Election is a Qualified Party.

The reason it took so long for the BOE to Recognize the Green Party is that there were No Members of the BOE, owing to a dispute between the Governor and the Legislature.

The State Board’s web page says that all the Member slots are “vacant.”

This is because in 2017 the State Legislature passed a Bill changing the Makeup of the State BOE, and the New Democratic Governor Roy Cooper Sued to Invalidate the New Law.

The Lawsuit, Cooper v Berger, 52PA17-2, was Pending in the State Supreme Court, the Lower State Court had Rejected the Lawsuit.

Until it was settled, the Employees of the BOE maintained that there is No BOE.

It was Settled last week.
