Federal Court Challenge to Texas Voter ID Law


Last week, the U.S. Supreme Court allowed Texas to continue enforcing their Voter ID law while an appeal continues.

A Federal court challenge is by voters and elected Democrats who argue that the 2011 law improperly limits the voting rights of minority, lower-income and older Texans who are less likely to have approved forms of photo identification.

The 5th U.S. Circuit Court of Appeals will hear oral arguments in that challenge May 24 in New Orleans.

In the Federal lawsuit, a three-judge panel of the 5th Circuit Court last year ruled that the law violates the Voting Rights Act, which prohibits voting procedures that discriminate on the basis of race, skin color or ethnicity.

But at the urging of Texas Attorney General Ken Paxton, the entire 5th Circuit stepped in last March, blocking the panel’s ruling so all 15 active judges can decide whether the law was Constitutional.
