New Lawsuit Filed Against Alabama Government Photo ID Requirement

On December 2, two organizations that advocate for voting rights filed a lawsuit against Alabama’s requirement that voters at the polls must show certain kinds of Government photo-ID.

The case is Birmingham Ministries and NAACP v State of Alabama, Northern District, 2:15cv-2193.

The case was assigned to U.S. District Court Judge L. Scott Coogler, a Bush Jr. appointee.

CLAIMS

Count One: The Photo ID Law Violates Section 2 of the Voting Rights Act (52 U.S.C. § 10301). The Photo ID Law and its implementation result in a substantial and disproportionate number of African-American and Latino voters.

Count Two: The Undefined Positively Identify Provision Violates Section 201 of the Voting Rights Act (52 U.S.C. § 10501). The Photo ID Law’s undefined Positively Identify Provision violates the prohibition on those tests or devices by requiring, as a prerequisite to voting, that otherwise eligible registered voters who lack the required photo ID prove their qualifications by the voucher of two election officials.

Count Three: The Photo ID Law Violates the Fourteenth Amendment (U.S. Const. amend. XIV, 42 U.S.C. § (1983). The Photo ID Law was purposefully enacted or operates to deny or abridge the right to vote on account of race or color.

Count Four: The Photo ID Law Violates the Fifteenth Amendment (U.S. Const. amend. XV, 42 U.S.C. § 1983). The Photo ID Law was purposefully enacted or operates to deny or abridge the right to vote on account of race or color.
