The Justice Department (DOJ) on 6/30/2026 Directed its Staff to bring Fraud Charges in Alleged Cases of Birth Tourism, as a Response to their Loss in the Birthright Citizenship Ruling from the Supreme Court on 6/30/2026.
In the wake of the 6-3 Ruling, a Memo from the DOJ’s Office of the Deputy Attorney General said All Criminal Division Staff should “prioritize the investigation and prosecution of birth tourism schemes.”
“The Department of Justice will zealously protect the sanctity of United States citizenship by investigating and prosecuting those who fraudulently exploit our immigration system,” Colin McDonald (R), Head of the Justice Department’s Fraud Division, wrote in the Memo.
Birth Tourism is already Illegal, though McDonald’s Memo tells Prosecutors to consider using other Statutes to Prosecute such Cases, including Wire Fraud and Money Laundering. Studies on Cases of Birth Tourism suggest the Practice is Rare.
“Though hard to know for certain, the most expansive albeit contested estimate based on review of U.S. Census Bureau data is that up to 26,000 babies born in the United States annually could be attributed to birth tourism—a tiny fraction of the more than 3.5 million U.S. births yearly,” the Migration Policy Institute wrote in a Review earlier 2026.
In the majority Opinion, Chief Justice John Roberts (R), joined by All Three Liberal Justices and Justice Amy Coney Barrett (I), wrote that the 14th Amendment Gguarantees Automatic Citizenship for nearly All Children Born on U.S. Soil, even those Born to Parents in the Country Unlawfully.
“The trouble is that there is scant evidence for this dramatically revisionist view,” Roberts wrote of Trump’s Day 1 Executive Order.
After the Ruling, Trump Suggested in a Social Media Post, that He would use Congress to End Birthright Citizenship, after the Supreme Court Ruled Aagainst Hhis Efforts.
“The Supreme Court upheld Birthright Citizenship, which is too bad for our Country, but we can easily make it up in Congress through Legislation, with the support of the President, that has now been determined during this process,” Trump wrote on Truth Social.
