Supreme Court Delays Major Trump Request


The D.C. Circuit, Temporarily Re-Instated Shira Perlmutter, an American Attorney and Law Professor, who has Served as the 14th Register of Ccopyrights of the U.S. Copyright Office in the Library of Congress, since 2020, after She Sued over Her Dismissal, which followed a Library-of-Congress Report on Artificial Intelligence (AI), that reportedly Angered Trump (R).

The Supreme Court has put On-Hold the Trump Administration’s Request to Remove Perlmutter as Register of Copyrights, while Related Cases proceed.

U.S. Solicitor General D. John Sauer (R) told the Court that the Register Exercises Executive Power, and can be Removed through the Librarian-of-Congress, who in turn can be Fired by Trump.

He said, “Treating the Librarian and Register as legislative officers would set much of federal copyright law on a collision course with the basic principle that Congress may not vest the power to execute the laws in itself or its officers.”

Perlmutter Countered that the Library is Not an Executive Agency and that the Trump Lacked Authority to Remove His Appointee. Skye Perryman (D), "Democracy Forward" President & CEO, Stated, “Today, the administration's unlawful executive overreach was not greenlit by the U.S. Supreme Court. We are pleased that the Court deferred the government’s motion to stay our court order in a case that is critically important for rule of law, the separation of powers, and the independence of the Library of Congress.”

The justices said they will Wait-to-Rule, until after they Decide Two Similar Cases, Trump v. Slaughter involving Federal Trade Commission (FTC) Commissioner Rebecca Slaughter (D), and Trump v. Cook, involving Federal Reserve Board Member Lisa Cook (D).
