A Federal Judge on Friday, Ruled that the Trump (R) Administration had Overstepped Legal Limits, in its Effort to Hold and move Migrants Designated for Deportation at the U.S. Naval Base at Guantanamo Bay, Cuba.
The Ruling delivers a Significant Legal Setback for the Administration’s Hard‑Line ImmigrationEenforcement Policy, adding to a Series of Court Challenges that have questioned the Legality, and Scope of its Immigration Enforcement Tactics, particularly the use of Guantanamo Bay as a Detention Site for Migrants awaiting Deportation.
In February, the White House began holding Migrants designated for Deportation at Guantanamo Bay, following an Order from Trump to prepare the Facility to accommodate up to 30,000 Individuals.
Judge Sparkle L. Sooknanan of the U.S. District Court in Washington, D.C., Denied the Government’s Request to Dismiss a Class-Action Lawsuit filed by the American Civil Liberties Union (ACLU).
The Judge did Not Order Secretary of Homeland Security (DHS) Kristi Noem (R) to Close the Facility. The ACLU said the Organization Plans to Seek a Closure Order: a CourtDdirective that requires a Facility to be Shut-Down.
In Her Ruling, Judge Sooknanan concluded that Federal Law does Not Authorize the Administration to Hold Deportable Migrants at Overseas Military Installations.
The Ruling arose from Litigation brought by Immigrant Rights Groups and Individual Migrants, who Argued that using an Overseas Military Facility to Detain People subject to Ordinary Immigration Proceedings Violated Federal Immigration Law and Statutory Limits on Executive Power.
Plaintiffs said Transfers to Guantánamo, Denied Detainees meaningful Access to Counsel, Review, and other Protections Normally available in U.S. Immigration Proceedings. The ACLU Filed a Class-Action Lawsuit Challenging the Policy, citing Two Men who had been Deported through the Base.
The Organization Argued that Detainees at Guantanamo Bay are kept in a Legal Limbo, caught between Deportation and Detention on U.S. soil, where they would have better Protections and Access to Counsel.
Immigration Authorities have held roughly 710 Male Detainees at the Facility, using a Tent setup, supported by Hundreds of U.S. Soldiers and Marines.
The Ruling may create Substantial Operational and Political Complications for the Trump Administration, which has framed Tougher Immigration Enforcement as Central to its Agenda. Whether the Administration will Appeal or attempt to Revise its Approach, remains to be seen.
