U.S. Magistrate Judge Gabriel Fuentes, Approved the Dismissal after the Grand Jury issued a “No Bill,” indicating Insufficient Evidence to Proceed. Assistant U.S. Attorney Brian Havey said the Decision Applied only to the Original Complaint.
Prosecutors Alleged the Couple Refused Police Orders and Resisted Arrest, while Defense Attorney Richard Kling said Collins’ Licensed Firearm was Unrelated to the Protest.
Kling said, “I’ve been practicing law for 54 years and I’ve never had another client with no bill returned.” He added, “This is a once-in-a-lifetime for me.”
Two other Protesters still face Charges. Paul Ivery faces Charges of Threatening an Agent, and Dana Briggs faces Charges of Striking an Officer while Handing over His Phone.
The Dismissal of Charges against Collins and Robledo, coincided with Heightened Security Measures at the Broadview ICE Facility. National Guard Troops were Deployed to assist Federal Immigration Enforcement operations after earlier Clashes with Protesters.
