Judge Delivers Scathing DOJ Rebuke in Comey Case


U.S. Magistrate Judge William Fitzpatrick Sharply Criticized Justice Department (DOJ) Prosecutors for an “indict first, investigate later” Approach, in the Criminal Case against former FBI Director James Comey (I) and Ordered Immediate Production of Grand Jury Transcripts and Evidence Seized from Comey’s friend Daniel Richman.

Fitzpatrick said, “The procedural posture of this case is highly unusual. We’re going to fix that, and we’re going to fix that today.”

Comey is Charged with One Count of making a False Statement and One Count of Obstructing a Congressional Proceeding, related to His 2020 Senate Testimony, to which He has Pleaded Not Guilty.

His Lawyers argue the Prosecution is Vindictive, Point to Withheld Materials, and Potential Attorney‑Client Privilege, Classified‑Information Issues, and Challenge the Interim U.S. Attorney’s Appointment.

One of Comey’s Attorneys, Rebekah Donaleski, said, “The defense is gravely concerned with the government’s conduct.”

Prosecutors say Potentially Privileged Material has been Isolated, and the Court Pressed for Rapid Turnover of Discovery ahead of the January Trial Date, despite the Compressed Schedule.

The Indictment followed Public Calls by Trump (R) to Prosecute Critics, which the DOJ says Do Not Show Improper Motive.
