Trump Cracks Down on Immigrant Sponsors

The Trump (R) Administration has Issued a Stern Advisory to American Citizens and Entities Sponsoring Immigrants, Cautioning that Failure to Meet Financial Obligations could Result in Substantial Fines, Civil Lawsuits, or Criminal Prosecution.

This U.S. Citizen and Immigration Services (USCIS) Memorandum Reinforces existing Requirements under the Immigration and Nationality Act (INA), Prohibiting Sponsored Family-based Immigrants from Accessing Means-Tested Public Benefits, such as Welfare, Food Assistance, or Housing Aid, without exposing Sponsors to Liability.

Since the Memo, Increased USCIS Audits of over 5,000 Sponsorship Affidavits have Uncovered Discrepancies in nearly 15% of Cases, leading to Fraud Investigations.

Under the Policy, Sponsors must Actively ensure that Beneficiaries Refrain from relying on Taxpayer-Funded Programs, as doing so Triggers Repayment Demands from the Administering Agencies. Beneficiaries themselves may pursue Legal action against Sponsors for any Shortfall in Promised Support.

The USCIS Memo states, “If fraud is suspected, cases may be referred to the USCIS Fraud Detection and National Security Directorate for review and investigation.”

USCIS Spokesman Matthew Tragesser (R) emphasized the Importance of Compliance, stating, “It is crucial for sponsors & aliens to meet their fiscal obligations & not push financial burdens onto the American people.”

The Agency has Intensified its Review Processes for Green Card Applicants, particularly Scrutinizing those with Histories of Public Benefit Usage, which could Render Individuals Ineligible for Permanent Residency or Naturalization.

Tragesser said, “USCIS is adding a new element to the naturalization process that ensures America’s newest citizens not only embrace America’s culture, history, and language but who also demonstrate Good Moral Character.”

USCIS Director Joseph Edlow (R) Highlighted the Administration’s Commitment to Rigorous Enforcement, aimed at Deterring Voter Fraud, Identifying Unqualified Applicants, and Safeguarding Public Resources through Enhanced Accountability Measures.
