Judge Blocks Trump Deportation Order


U.S. District Judge Timothy Kelly, has Issued a Preliminary Injunction Halting Trump (R) Administration’s effort to Deport Unaccompanied Guatemalan Children.

The Operations came under Scrutiny over Reports of Late Night Removals from Shelters, with Advocates Warning that Legal Protections may be at Risk. Kelly has Limited the Injunction to Guatemalan Children, and Allowed Exceptions for Final Removal Orders or Certified Voluntary Departures.

The Case stemmed from Labor Day Weekend Actions, when about 70 Minors were Moved toward Flights Reportedly from Shelters.

Judge Sparkle Sooknanan First Issued an Emergency Order in Early September, that Stopped Planned Flights after Late Night Transfers of Minors. Kelly Extended the Order and found Government Claims about Parental Requests Unsubstantiated.

Guatemalan Authorities Reported they could Not Locate most Parents, and that Located Parents had Not Requested Returns.

Department of Justice (DOJ) Attorney Drew Ensign (R), Noted that another DOJ Lawyer had Withdrawn. DOJ Attorney Sarah Welch (R) expressed Regret over the Operation’s Handling and Aacknowledged that the Children were Frightened. Advocates Argued the Removals may Violate Immigration Laws.

Trump Administration Spokespersons have Defended the Effort, and Blamed former President Biden’s (D) Policies for the Influx of Unaccompanied Minors. The Court has Paused Removals to Guatemala, while the Case Proceeds.
