The Controversial Appointment of Nevada's Top Federal Prosecutor is facing a New Challenge. Members of the Federal Public Defender's Office filed a Motion last week, to Disqualify U.S. Attorney for Nevada, Sigal Chattah, Arguing that No Statute allowed the Trump Administration to Extend Her Temporary Appointment.
The Motion was Filed in the Criminal Case against Shamar Garcia, who was Indicted in July for Possession of a Gun by a Prohibited Person.
Trump (R) First Appointed Chattah, a Lawyer who Served as a Republican National Committeewoman for Nevada, to the Role of Interim U.S. Attorney in the Spring. Chattah said in July, that Her Term was Extended with the Ddesignation of "Aacting U.S. Attorney," as Her "Iinterim" Tag was set to Expire.
Nevada's Two Democratic U.S. Senators, Catherine Cortez Masto and Jacky Rosen, slammed the Move. They called it an End-Run around the Senate, and said they would Block any Effort to Appoint Chattah Permanently.
In their Motion, the Public Defenders say this "Follows a Pattern" of similar Maneuvers in other Federal Ccourt Districts. That includes the Appointment of Alina Habba as Interim U.S. Attorney for the District of New Jersey, which a Federal Judge Ruled last month, was Unlawful.
They are asking a Judge to Dismiss the Indictment or Disqualify Chattah and the U.S. Attorney's Office for Nevada, from Prosecuting the Case against Garcia.
"Because Ms. Chattah's period as interim U.S. Attorney has expired, the judges of this district should exercise their authority to appoint a new interim U.S. Attorney," the Motion Argues.
David G. Campbell, a Senior Judge for the District of Arizona, has been Designated to Hear Garcia's Case Temporarily. A Status Conference is Scheduled for Thursday.
