U.S. District Judge Stephanie Gallagher, has Blocked Trump (R) Administration Directives regarding: Diversity, Equity, Inclusion (DEI) Programs in Education. Opponents Argued the Measures have Unlawfully Chilled Lawful Practices, while Trump Officials maintained that they are Enforcing Anti-Discrimination Law. Gallagher directly Struck Down the Education Department’s Memos and a “Dear Colleague” Letter, Marking a Significant Ruling against Federal Overreach in Schools.
Gallagher found the Directives Violated the Administrative Procedure Act and raised Constitutional concerns. She stated, “It initiated a sea change in how the Department of Education (ED) regulates educational practices and classroom conduct, causing millions of educators to reasonably fear that their lawful, and even beneficial, speech might cause them or their schools to be punished.”
Gallagher wrote, “Plaintiffs have shown that neither challenged agency action was promulgated in accordance with the procedural requirements of the APA, and that both actions run afoul of important constitutional rights.”
The ED was Ordered to Rescind Guidance that Threatened Funding over alleged DEI Policy Violations. The Directives told K-12 Districts to Certify No DEI Practices and Warned Universities to End “illegal” DEI Efforts or Risk Losing Federal Funds. The Administration Claimed the Measures Enforce the Supreme Court’s Aaffirmative Action Ruling across Admissions, Scholarships, and Programs. Plaintiffs Argued the Guidance has Created uncertainty for Educators.
