The Pentagon released its New Policy Wednesday, for Transgender Troops to Serve in the Military, which requires them to demonstrate they “have never attempted to transition to any sex other than their sex.”
The Memo directs the Military to Identify Transgender Service Members by March 26th and “Separate” or Remove those who Don’t Obtain Waivers by June 25th.
Darin Selnick (R), who is Performing the Duties of the Undersecretary of Defense for Personnel and Readiness, said in a Letter accompanying the Policy that any Service Members processed for Separation would be “afforded all statutorily required rights and benefits.”
The Filing is the latest Salvo in a Federal Lawsuit by Transgender Troops who are Fighting Trump’s (R) Executive Orders seeking to Block the Troops from Service. Trump's Orders define only Two Sexes and State that Gender Dysphoria is Incompatible with Military Service.
The Military hasnow Halted Recruitment of Transgender Troops, which was allowed under the Biden (D) Administration, but has Not yet begun "Separating" or Removing Transgender Soldiers from Service.
U.S. District Judge Ana Reyes, who is Presiding over the Case, held Two fiery days of Hearings last week, about whether to Block the Military Policy. But She postponed Her Decision until after the Pentagon’s Policy was Released.
Individuals who have a current Diagnosis or History of, or Exhibit symptoms consistent with, Gender Dysphoria are No longer Eligible for Military Service. The Department only recognizes Two Sexes: Male and Female. An Individual's Sex is Immutable, Unchanging during a Person's Life. Use of Bathrooms, Berthing, and Shower Facilities will be subject to the Service Member’s Sex at Birth.
Absent Extraordinary Operational Necessity, Male Service Members won’t Use or Share Sleeping, Changing, or Bathing Facilities designated for Females, nor will Female Service Members use Facilities Designated for Males. No Military Funds will be used to Pay for Service Members’ Planned Medical Procedures Associated with Facilitating Sex Reassignment Surgery, Genital Reconstruction Surgery as Treatment for Gender Dysphoria, or Newly initiated Cross-Sex Hormone Therapy.
The Policy also states that Transgender Service Members won’t be allowed to Remain in the Military unless they obtain a Waiver. The requirements include:
- Stability for 36 months without Clinical Significant Stress.
- Demonstrating that “he or she has never attempted to transition to any sex other than their birth sex.”
- Adhering to All “standards associated with the service member’s sex.”
Transgender Service in the Military has been a Battleground for years. The Pentagon began accepting Transgender Troops in June 2016. The Change came after a yearlong Study and a Rand Corp. Report on 18 other Countries that allow Transgender Service found it would have No Adverse Impact on Unit Cohesion, Operational Effectiveness or Readiness.
Defense Secretary Ash Carter (R) said the Military would be best served when Transgender Individuals “can no longer be discharged or otherwise separated from the military just for being transgender.” Trump Banned Transgender Service during His First Term.
Judges in Four Lawsuits initially Blocked His Order until the Supreme Court Cleared the way for a Revised Policy in January 2019, which Barred Transgender People from Enlisting, Participating in Reserve Officers' Training Corps, or Attending Military Academies.
“This is a stark reversal of military policy,” the Lawsuit says. Transgender People "will be discharged from service, lose their means of supporting themselves and their families, and stripped of the honor, status, and benefits associated with uniformed service to their country.”
