OH New Voter ID Law Adds Provisional Ballots


November 5th, will be the First Presidential Election with Ohio's New Voter ID Law. If there's a Question about your Eligibility to Vote, you might have to Cast a Provisional Ballot. Most Provisional Ballots are Counted after Election Officials Verify that Voters are Eligible.

Ohioans must Provide One of these Unexpired forms of Identification to Vote-in-Person, either Early or on Election Day:

- Ohio Driver’s License, It does not need to List your Current Address where you are Registered to Vote. It does Not have to be a REAL ID.

- Ohio State ID Card.

- U.S. Passport or Passport Card.

- Military Identification issued by the Ohio National Guard or U.S. Government.

- U.S. Veterans Affairs ID Card.

- Interim Identification Form issued by the Bureau of Motor Vehicles (BMV).

Some Examples of when you might be Asked to Cast a Provisional Ballot:

- You don't bring a Photo ID to Vote-in-Person. This year's Election is the First Major Test of Ohio's New Photo ID Requirement that went into effect in 2023.

- You Requested an Absentee Ballot but Changed-Your-Mind and decided to Vote-in-Person.

- Your Name isn't in the Poll Book or your Signature doesn't Match what's in the Poll Book.

- You Moved after Registering to Vote and didn't bring Proof of that Change.

- You are a College Student who Registered to Vote at Home but chose to Vote at School or Vice Versa.

- You Changed your Name after Registering to Vote and didn't bring Proof of that Change.

A Provisional Ballot is Not the same thing as an Absentee Ballot, which Voters can use to Vote-by-Mail or Drop-Off at their County Boards-of-Election.

If you are asked to Vote Provisionally, you will receive a Paper Ballot to Fill-Out. You will also be asked to Fill-Out and Sign a Form with your Name, Address, Date-of-Birth, and other Information. You will receive a Notice on how to Ensure your Ballot is Counted. Your Ballot will be Sealed in an Envelope until the County Board of Elections determines whether you are Eligible-to-Vote.

If you are Voting Provisionally, because you did Not bring a Photo ID, you have Four days to bring Proof of Identification to your County Board of Elections for your Vote to Count. If you have a Religious Objection to being Photographed, you can Fill-Out a Form indicating that Objection within Four Days and your Vote will Count.

Provisional Ballots are Counted after the County Board-of-Elections ensures you are Eligible to Vote. That means your Vote won't appear on the Unofficial Election Results on Election Night, Nov. 5th.

After Election Day, Local Election Officials will start Checkimg whether you are Eligible to Vote. That includes Double-Checking that a Voter didn't Cast more than One Ballot, Verifying Photo ID, or ensuring Voters were Registered in Ohio. The County Board of Elections will Vote during a Public Meeting on whether to Count or Reject Provisional Ballots.

Then, All Eligible Provisional Ballots are Counted, even if they won't make a Difference in the Outcome of an Election. Those Votes are included in the Final, Official Election Results. Ohio will Issues a Report each Election on why Provisional Ballots were Rejected.
