Jack Smith Wins Pivotal Decision as Trump Case Gains Momentum


Special Counsel Jack Smith has received Good News regarding the Federal Case surrounding Trump’s alleged Election Subversion. Previously, the U.S. Supreme Court Ruled that Trump has Immunity from Prosecution for Official Actions taken while in Office. But the Court also said the Lower Courts will determine in each Case, what is Official or Not.

The Case "United States of America v. Donald J. Trump" involves Federal Criminal Charges against Trump related to His alleged Efforts to Overturn the 2020 Presidential Election as well as His Role in the January 6 Capitol Attack.

In August 2023, a Grand Jury indicted Trump in the District of Columbia on Four Charges. The Charges carry a maximum sentence of 20 years. In February 2024, the Trial was Dlayed until the Court ruled on Trump's Immunity from Prosecution. The U.S. Supreme Court acknowledged some Immunity for Official Acts. In August 2024, Smith filed a Superseding Indictment, which includes some of the same Four Charges, but Removing certain Allegations that He decided might fall within the Courts Immunity.

Smith had now sought for Permission to file a nearly 200-page Brief which would specifically address Presidential Immunity matters in the Case surrounding Trump's alleged Election Subversion.

"I shouldn't have a protective order placed on me because it would impinge upon my right to FREE SPEECH," Trump said over the matter.

Trump's Defense argued that the Lengthy Brief is Excessive and Unfair, but Judge Tanya Chutkan Dismissed their concerns, stating that the Request is Consistent with Legal Proceedings.

"Allowing a brief from the Government is not 'contrary to law procedure, and custom,' as Defendant claims...it is simply how litigation works," Chutkan's Order stated. The Brief will also introduce New Evidence against Trump.
