Judge Rejects SD Lawsuit Removing Abortion Amendment From Ballot


Circuit Judge John Pekas, Dismissed a Lawsuit from the Pro-Life Group “Life Defense Fund" intending to Remove South Dakota Constitutional Amendment from the November Ballot Monday.

Barring other Lawsuits, South Dakotans will have a chance to Vote on Conditionally Ending Bans on Abortion in the Mount Rushmore State.

The Amendment began as an Initiated Measure organized by “Dakotans for Health”. If Passed, the Amendment would Prohibit Government Regulation on First-Trimester Abortions in the State, and conditionally Prohibit Regulation on Second and Third-Trimester Aabortions.

Despite Abortion being a Polarizing issue, Dakotans for Health Co-Founder Rick Weiland, says recent Polling Data suggests Bipartisan Support for the Amendment.

“46% of Republicans support our reproductive rights amendment that would overturn this strict abortion ban we have. Which I would present as one of the more radical abortion bans in the country.” Weiland said.

Weiland described the Court Decision as a “Win for reproductive rights and direct democracy.”
