Trump's Security Clearance When He Left Office


When a President leaves Office, they Lose their Security Clearance.

The former Presidents can Request Access to Classified Information from the current Sitting President1. Biden has the Authority to Grant or Deny Access to Classified Information to Trump. He did Not give that Authority.

If a Security Clearance is Granted, a former Presidents are Not subject to the same Background Investigation Process as typical Security Clearance Holders.

The Presidential Records Act of 1978 (PRA), requires the National Archives take Custody of All Presidential Records at the End of a President’s Time-in-Office.

The PRA states that any Records Created or Received by a President while in Office are the Property of the U.S. Government, and will be Managed by the National Archives and Records Administration (NARA) at the End of their Term.

The PRA defines Presidential Records as Documentary Materials Created or Received by the President or His Staff, in the Course of their Official Duties in Office.

The Law excludes Personal Records, such as Diaries, Journals, or other Personal Notes “of a purely private or nonpublic character,” as well as Federal Records created during their Term, according to the Congressional Research Service.
