NYC Mayor Sues 17 Bus Companies Transporting Migrants to City


New York City Mayor Eric Adams’ (D), Administration is Suing 17 Charter Bus and Transportation companies, that it says have helped Texas Gov. Greg Abbott (R), bus Migrants into New York City, demanding that they pay $708 million to Cover the city’s Costs of Caring for the Migrants.

The Suit, filed Thursday in a Manhattan State Court, represents One of the Administration’s most Ambitious attempts yet, to get a handle on the Crisis and Recoup some of the more than $3 billion it has already spent to House and Feed Asylum-Seekers since 2022. It also Escalates a bitter Dispute between Adams and Abbott, who has taken Credit for Transporting some 34,000 People to New York City, in an effort to Spotlight the Biden Administration’s Immigration Policies.

“New York City has and will continue to do our part to manage this humanitarian crisis,” Adams said in a Videotaped Statement released alongside the Lawsuit. “But we cannot bear the costs of reckless political ploys from the state of Texas alone.”

Adams' Administration has notified the Bus and Transportation companies, limits for Bus Arrivals into city as Migrant entries Surge and to notified NYC well in advance of the Arrivals. Since the 17 companies have Not taken any steps to care for the Migrants upon their Arrival, the City contends they are Breaking the State’s Social Services Law, which requires any Person who “knowingly brings … a needy person” into New York to either “convey such person out of state or support him at his own expense.” The City says All 17 companies have Contracts with the State of Texas.

In addition to its Own Lawyers, the City is being Represented in the Suit by the Law Firm Paul, Weiss, Rifkind, Wharton & Garrison. The Firm’s Attorneys on the Case include Steven Banks, a Former Commissioner of the City’s Department of Social Services, who is simultaneously Opposing the Adams Administration’s effort to Weaken the City’s Right-to-Shelter Mandate in a separate Court Case.

Adams last week, issued an Executive Order that Limits when Buses carrying Migrants can Arrive in the City, but within days the Mayor accused Abbott of getting around the Policy by dropping off Migrants in New Jersey, and other States, and then Busing them to New York City.

Adams has Not seen much Success in prior efforts to Ease the City’s Pressure through the Court System: Last year, the Administration dropped most of the Legal Challenges it had filed against Upstate County Governments, as part of an attempt to Force them to Accommodate Migrants.

Gov. Kathy Hochul (D), said in a Statement that She supports the Mmayor’s Suit, although the State has Not signed on as a Party.

The 34,000 Migrants that Abbott says He has brought to New York City, are only a Fraction of the 164,000 Asylum Seekers that have come through the City since April 2022. The City arrived at its $708 million Damages figure, by Calculating how much it has spent on Migrants Transported from Texas alone.

The City is Suing the Bus Companies instead of Abbott himself, because the U.S. Constitution Bars State Governments from being Sued without their Consent, an Adams Spokeswoman said.

The ongoing Crisis will Cost the City as much as $12 billion through the Middle of 2025, according to the Adams Administration. With a $7 billion Budget Gap to Close in the Next Fiscal year, Adams Ordered an Across-the-Board 5% Budge-Cut to nearly All City Agencies in November, to be followed by at least One more this year.

Critics have Argued that the City’s Fiscal Situation is Not as dire as Adams says, and note that the Migrant Crisis is Not the only Contributor to the City’s Deficits.
