The 2nd Circuit Court of Appeals, has Officially Denied Trump's attempt to seek En Banc, full Court Review of a District Court's Decision, finding that Trump could Not assert an Immunity Defense, in a Case brought by Writer E. Jean Carroll.
Previously, a District Court ruled that Trump's Attorneys did Not timely Assert the Immunity Defense, thereby Waiving it ahead of an upcoming Trial on the Alleged Defamatory Statements.
According to the Lower Court Filings, Trump's Team waited several years, after the Case was Initially filed to Assert the Immunity Defense.
While the District Court did Not evaluate the Veracity of the Defense, it did determine that Trump's Request was Not timely.
The 2nd Circuit Panel of Three Judges, later agreed with the District Court's Analysis, Rejecting Trump's attempt again.
After that Ruling, Trump's Team moved for an Een Banc Review, which would have the entire 2nd Circuit Review the prior Appellate Decision.
Today, that Request was Denied. As a Result, expect Trump to appeal the Decision to the Supreme Court, in a swift manner, given the Trial is Scheduled to begin in just a couple of Weeks.
