Independent State Legislature Theory


The Supreme Court (SCOTUS) is about to hear a Case, that has big implications Not only for the Fight for Fair Maps, but also for the U.S. System of Checks and Balances.

Last year, Voters in North Carolina Overturned a Gerrymandered Congressional Map in State Court.

Now they're headed to SCOTUS to Defend the Fair Map and Stop Republicans in their State, who want to Reinstate their Gerrymandered Map.

But, North Carolina’s extreme Republicans now has turned to the “Independent State Legislature” Theory (ISL), a Fringe Legal Theory, claiming that State Legislatures have Exclusive power to regulate Federal Elections.

When those extreme Republicans argue their Case in front of SCOTUS this week, they will be asking the Court to dismantle State-Level Judicial Review of State Legislation impacting Federal Elections, effectively preventing State Courts from providing Checks and Balances as needed to Protect Voters’ Rights and the Electoral Process.

If SCOTUS sides with the extreme Republicans pursuing this Case, the Fair North Carolina Map, will be Replaced with the Gerrymandered one, already determined to Violate the North Carolina Constitution. But this SCOTUS decision could also cause ripple effects to our Democracy beyond this One Map.

We’ve seen extreme Republicans go to great lengths to Overturn Election results. Now they are asking the SCOTUS to give Unchecked Power to State Legislatures, including those that remain heavily Gerrymandered.

This is a Desperate and Reckless attempt to Dismantle the Accountability that prevents Extreme, Power-Hungry Politicians from successfully Manipulating Maps in the First place.

We won’t know what the Justices decide until Spring 2023, but we need to be prepared for any outcome.

This Case has the potential to completely Change the Landscape of our Federal Elections.

If you have been reading my Blog, you know I have been saying it is time to take Federal Election Tallying away from the States. It should be done by a Professional Certified Election organization run by the Federal Government. I would really like if the whole Federal Election process run by that Certified Professional organization.
