DNC And Democtatic State Party Warn New AZ Election Law Is Unconstitutional


In a Demand Letter, the Democratic National Committee (DNC) and the Arizona State Democratic Party, took aim at Provisions of, Senate Bill 1819, that could Purge from the Rolls, Voters who are only Registered to Vote for Federal Offices.

By Targeting this Subgroup of Voters, Arizona violates Equal Rights and Free-Speech Protections guaranteed by the U.S. Constitution, the Democrats wrote in a Demand Letter to Arizona Secretary of State, Katie Hobbs (D) and Attorney General, Mark Brnovich (R). The Bill also Violates the National Voting Rights Act (VRA), the Complaint stated.

They ask the State Officials to Resolve the Issue before it takes effect Sept. 29th, or face a Lawsuit.

SB 1819 is a wide-ranging Collection of Unrelated Policies, including a Review of how the Secretary of State maintains the Voter Registration List, in regard to, Voters who are Registered to Vote for Federal Races only. Typically, these are Voters who did Not provide Proof-of-Citizenship when Registering to Vote. Arizona Law, but Not federal Law, requires Verification of U.S. Citizenship.

The Review would be done by someone Appointed by the Legislature and would focus on whether the List is Maintained in Compliance with Federal Requirements.

If the Review finds People who are Not Eligible to be Registered Voters, County Elections Officials would be Directed to Remove them from the Voter Rolls.

This Process Violates numerous Laws and Constitutional Quarantees, the Democrats state.

In a Statement, Brnovich's Office pointed to his Duty to Defend Laws Passed by the Legislature. "General Brnovich has a long track record of defending Arizona’s election-integrity laws, recently winning at the U.S. Supreme Court in Brnovich v. DNC, and he will continue to do so," Spokesperson, Katie Conner, wrote in a Statement.

The Law is also the Target of a Citizen Referendum Drive, launched last month. The Arizona Deserves Better Campaign has until Sept. 28th to gather the Signatures of 118,823 Registered Voters to put the entire Bill, On-Hold, until Voters can decide it at the November 2022 General Election.

The Referendum Targets not Only the Review of how Federal-Only Voters are Treated, but other Provisions of, SB 1819, that include 10 Measures intended to Counteract "ballot fraud," a $500,000 Allocation to Investigate Social-Media Platforms and a Shift in the Responsibility for Defending Election Laws from the Secretary of State to the Attorney General, but Only until Hobbs' Term Ends, in January 2023.
