NYC Mayoral Candidate Sues BOE RCV Count


New York City Mayoral Candidate and Brooklyn Borough President, Eric Adams, filed a Preemptive Lawsuit, Wednesday, to “ensure a fair and transparent election process” after the Board of Elections (NYCBOE) Botched the June 22nd Primary, In-Person Vote Outcome, by Accidentally including 135,000 Test Ballots.

The NYCBOE didn't Remove Test Ballots from the Tally System, before they started the Ranked-Choive-Voting (RCV) Process for Only the In-Person Voting, Early and Election Day Ballots, Results.

“Today we petitioned the court to preserve our right to a fair election process and to have a judge oversee and review ballots, if necessary,” Adams said in a Statement.

“We are notifying the other campaigns of our lawsuit through personal service, as required by law, because they are interested parties,” Adams said.

“We invite the other campaigns to join us and petition the court as we all seek a clear and trusted conclusion to this election,” he added.

The Suit was filed, Wednesday in Kings County Supreme Court.

Maya Wiley, former Counsel to Mayor Bill de Blasio (D) who came Third in the Botched Unofficial Results after winning an Endorsement from Representative Alexandria Ocasio-Cortez (D-14th District), also Criticized the NYCBOE.

"This error by the Board of Elections is not just failure to count votes properly today, it is the result of generations of failures that have gone unaddressed," Wiley said in a Statement.

"Today, we have once again seen the mismanagement that has resulted in a lack of confidence in results, not because there is a flaw in our election laws, but because those who implement it have failed too many times," Wiley said.

The NYCBOE is expected to run the RCv Process today..
