NY Court Case Over Petition Signatures for 2021 Primary


A New York State Court has Tossed a Lawsuit challenging Albany’s Decision to leave some Petitioning Requirements on the Books for this year’s Primary Elections.

Due to the Pandemic, and a desire to Reduce the Massive Number of Face-to-Face Interactions, required of Candidates gathering Signatures to appear on the Ballot, Lawmakers Approved a Bill that Temporarily Reduces the Minimum Number of Signatures for Ballot Access.

New York City:

— Citywide Petitions droped from 7,500 to 2,250.

- Boroughwide Petitions droped from 4,000 to 1,200.

- Lesser Local Office Petitions droped from 5% of the Number of Registered Members in any particular Party, to 1.5%.

- Any Office to be filled by All the Voters of any Municipal Court District droped from 1,500 to 400.

Statewide: Thresholds were set at 70% of the Existing Numbers.

Over 100 Individuals led by New York City Public Advocate, Jumaane Williams (D) Challenged this Change, arguing that any Petitioning Signature Requirements whatsoever are Unsafe.

New York County Supreme Court Justice, Frank Nervo, decided, on Tuesday, a day after Oral Arguments, that the Dispute over Petitions “is a disagreement of judgment, not constitutionality.”
