NY Prosecutor Oversight Bill


New York Gov. Andrew Cuomo plans to sign a Bill (S.02412-D/A.05285C) that creates a Watchdog Commission over Prosecutors, the First such Panel in the U.S.

Currently in New York State there is No Independent Oversight Body to Investigate Wrongdoing in the Offices of Local Prosecutors, despite Prosecutors having Unparalleled Authority and Discretion in the Criminal Justice System and a growing list of People, almost All People of Color, who have been Exonerated after Decades in Prison due to Misconduct on the part of either Prosecutors or Police.

The Bill would create the Commission on Prosecutorial Conduct. It Mirrors New York’s Commission on Judicial Conduct, which handles Complaints against Judges, and would have the Power to Investigate Citizens’ Allegations of Prosecutor Malfeasance and recommend Sanctions.

The Bill that creates the so-called Commission on Prosecutorial Conduct, Passed both the State Senate and Assembly, is on Cuomo's Desk and must be Signed or Vetoed by next Monday, 8/20/2018.

There have been Chapter Amendments, or Proposed Changes to the Bill, sent between the Governor's Office and the Legislature.

While Cuomo supports the Idea of the Commission, any Negotiations could still Fall through.

A Spokesman for Cuomo said the Bill was one of 500 pieces of Legislation Passed at the End of the Session. The Counsel's office is carefully reviewing the language and engaging with all stakeholders, the Spokesman said.

The Legislation, in its current form, would Create an 11-Member Panel consisting of People Appointed by the Governor, Legislative Leaders, and the State's Chief Judge.
