In a letter to the Editor of The New York Times Opinion Pages, Rev. Jesse L. Jackson Sr., President and Founder of the Rainbow PUSH Coalition Chicago wrote:
In “Virginia’s Racist Voting Law” (Op-Ed, July 19), Dale E. Ho didn’t mention a crucial issue: the underlying structural problem in America’s Voting system is that it’s built on States’ rights.
The fundamental individual right to vote is not in the Constitution.
The Right to Vote is not a Citizenship right, but a State right.
Since Voting is a State right, with few enforceable National standards, we have ended up with multiple and varied Election systems in the 50 States, plus the District of Columbia, all organized on what amounts to a “separate and unequal” Voting system.
Since the Shelby decision gutted the 1965 Voting Rights Act, voters in States with the greatest history of racial discrimination in voting, plus new ones, lack adequate Federal protection of their Right to Vote.
We need to add a Right-to-Vote Amendment to the Constitution that gives every American an explicit individual Right to Vote and that gives Congress the authority to create a Unified National Voting system with certain common-sense minimum standards.
