Last week, the New York State Board of Elections (BOE) was served with the first lawsuit challenging the qualifications of Ted Cruz to appear on the Presidential primary ballot.
A joint complaint by William Gallo of Nassau County and Barry Korman of New York City identical complaints object to Cruz by noting what they see as a distinction between the senator’s being a citizen, thus able to hold a seat in Congress, but not a Natural-Born citizen capable of serving in the White House.
The justice who signed the order to show cause changed the venue from New York County to Albany County.
Now, Albany State Supreme Court Justice David Weinstein will hear the challenge.
Reports indicate that the new judge has directed the BOE to answer the petition by 5:00pm on Feb. 26.
The Korman and Gallo petitioners must reply by morning of Feb. 29 and morning of Mar. 1, with oral argument.
The State Board has until tomorrow morning to indicate whether it objects to joining Ted Cruz as a respondent.
