PA Republicans Ask U.S. Supreme Court to Countermand State Supreme Court Order on When Ballots Must be Received

Thanks to Richard Winger of Ballot Access News for this post.

On September 28th, Pennsylvania Republican Leaders asked the U.S. Supreme Court to Countermand an Order of the Pennsylvania Supreme Court that Extended the Deadline for Postal Ballots to be received in Election Administration Offices.

The State Supreme Court said if the Envelopes have No Visible Postmark, they need Not arrive until Friday, November 6th.

The Case is Scranati v Pennsylvania Democratic Part, 20A53.

The Emergency Request came from Joseph Scarnati (R-25th District), the President Pro Tempore of the Pennsylvania State Senate, and Jake Corman (R-34th District), the Senate Majority Leader.

Although the Pennsylvania Supreme Court cited Concerns about COVID-19 in issuing its Order, Scarnati and Corman argued, the State’s Legislature has already taken Action to Minimize the effects of the Virus on the Administration of the General Election.

The Order, they contended, Violates Federal Election Law, which establishes a Single Election Day, by allowing Ballots Cast and Received after Election Day to be Counted. It also Violates the Constitution, they continued, which gives the State’s Legislature the Power to Set the Time, Place, and manner of Federal Elections.

More broadly, they stressed, allowing the State Court’s Ruling, to remain in effect, would sow “chaos into the electoral process weeks before” the November Election.

The Request is in the hands of Justice Samuel Alito, who handles such matters for Cases arising from Delaware, New Jersey, and Pennsylvania.

On Tuesday Sept. 29th, Alito called for a Response to the Pennsylvania Republican Party’s Request by Monday, Oct. 5th, at 3 p.m.
