Michigan Ballot Access Case

Thanks to Richard Winger of Ballot Access News for this post.

On August 22nd, a Hearing was held in U.S. District Court in Michigan, Judge Victoria A. Roberts and Magistrate Judge David R. Grand, for the Independent Candidate Ballot Access Case.

The Case is Graveline v Johnson, e.d., 2:18cv-12354.

Plaintiffs: CHRISTOPHER GRAVELINE, WILLARD H. JOHNSON, MICHAEL LEIBSON, and KELLIE K. DEMING.

Defendants: RUTH JOHNSON, Secretary of State of Michigan, and SALLY WILLIAMS, Director of Michigan Bureau of Elections, in their Official Capacities.

The Issue is the Michigan Law for Statewide Independent Candidates, which requires a Petition Due in July, even though the Primary is not until August.

The Petition Requirement, 30,000 Signatures, has been in existence since 1988, but in the years since then, only Twice has anyone Completed that Petition.

The plaintiff, Christopher Graveline, is running as an Independent for Attorney General. The Brief points out that the Secretary of State’s Brief didn’t even Defend that Deadline. Courts are virtually Unanimous that non-Presidential Independent Candidate Petitions can’t be Earlier than the Primary Date.

The Judge Indicated She would Rule shortly, perhaps in a Week.
