NY State Older Supreme Court Justices Forced Out Allowed to Re-Apply


New York, Chief Judge, Janet DiFiore, and the Office of Court Administration (OCA)’s Administrative Board, in Oct. 1st 2020, Denied Recertification of 46 of the 49 Judges who Re-Applied across New York.

Under State Law, Supreme Court Justices are Required to Apply for Recertification and Undergo Cognitive Exams every Two years after turning 70 until they Reach a Mandatory Retirement age of 76.

The Terminations was a Cost-Cutting Measure for a Court System seeking to Slash 10% of its Budget, or $300 Million, said Chief Administrative Judge, Lawrence Marks, in a memo sent to Administrative Judges across the State.

On Apr. 14th 2021, State Supreme Court Justices who reach, the age of 70, will again be able to Re-Apply for their Jobs and continue on the Bench, the State's Top Judge said.

The announcement by Chief Judge, Janet DiFiore, will allow New York to Retain the 46 Judges who were Forced to Retire due to their Age and Denied Certification to remain in Office.

DiFiore pointed to a Provision in the 2021 State Budget that Re-Funded the Positions for the Judges.

The Development was Cheered by the New York State Bar Association, which called the decision "welcome news."

"The association expressed its concerns Saturday that older justices were not allowed to remain on the bench, and they were relayed to top court officials," said the Group's President, Scott Karson.

"The announcement today by Chief Judge Janet DiFiore that this decision has been reversed will help our justice system run more smoothly and improve access to justice for lawyers and litigants.”
