Former DMV Commissioner Barbara Fiala can continue as interim chair of the state Women’s Equality Party (WEP) despite remaining an enrolled Democrat, but only until shortly after this year’s General Election.
Fiala, who was previously Broome County Executive, said she will formally announce her candidacy for state Senate. She’s running to replace Deputy Majority Leader Tom Libous, R-Binghamton, who was forced from office when he was convicted of lying to the FBI.
Since early this month, she has served as the interim chair of the WEP, the statewide third party created by Gov. Andrew Cuomo’s re-election campaign last year. But Fiala is an enrolled Democrat and said in an interview that she intends to remain one as she makes her Senate run.
Under the Women’s Equality Party rules, Fiala can remain interim chair until shortly after this year’s election.
“Each Interim State Committee member shall be a registered voter residing within the State of New York and, to the extent that such member shall continue in office after the first Tuesday following the General Election held in calendar year 2015, the member shall be an enrolled member of the WEP,” the party’s rules states.
Fiala said she plans on remaining a Democrat.
Under state law, the special election for Libous’ Senate seat will be Nov. 3, unless Gov. Andrew Cuomo takes the unlikely step of calling one before then.
